What is ARBITRATION?
- Replaces court room litigation altogether.
- Single neutral arbitrator, or a panel of neutral arbitrators.
- Arbitrators hear the parties’ claims and defenses, much like a judge. An arbitrator will issue a written decision after the hearing is concluded.
- Decision is binding, much like a judge’s decision in court.
What is MEDIATION?
- Each party may attempt to reach a resolution while the case moves towards trial.
- Use of a single neutral third-party mediator.
- Decisions are not made affecting the case, but mediator may offer opinions or predict outcomes based on expertise.
- Agreement is binding only when parties sign an agreement, executing the agreement as binding.
